Case Watch reports on various cases that California Court Collections has been successful in enforcing and collecting the monies owed.  It is updated on a quarterly basis.

Lawsuit Background

Plaintiff paid defendant a sum of money to perform a show including stage lights, props and other show materials. The defendant took the plaintiff’s deposit and never returned to perform any services whatsoever on the day of the event.  After several phone calls to the defendant and promises made to the plaintiff to return the deposit money, the defendant refused to take further calls from the plaintiff.  Thus, the plaintiff sued and clearly won a judgment against the defendant.

Outcome

The defendant refused to pay the court judgment after it was rendered by the court.  Therefore, California Court Collections was assigned the case to enforce the judgment on the defendant.  It was discovered that the defendant had an upcoming show to perform at a remote location. On the day of the show, California Court Collections levied the defendant’s client for the remaining monies owing on the event.  This amount was enough to satisfy the judgment.

Lawsuit Background

Defendant signed a 2-year lease agreement with the plaintiff.  After a 1-year period the defendant relocated to another residence without notice to the plaintiff and ultimately breaching the lease agreement.  Once the plaintiff learned that the rental property was vacated, he attempted to contact the defendant, but to no avail.  The plaintiff furthermore attempted to locate the defendant’s new address, and was successful in doing so.  The plaintiff therefore sued in court and secured a judgment against the defendant.

Outcome

The defendant failed to pay the judgment and California Court Collections was subsequently assigned to the case to enforce the judgment and was able to obtain the defendant’s current employer.  A wage garnishment ensued resulting in full satisfaction of the judgment.

Lawsuit Background

The plaintiff, a self-employed artist loaned money to a friend who promised a wise investment return on the plaintiff’s money.  When the plaintiff never heard from the friend again, he attempted to contact him by phone and later by personal visits.  The defendant never responded to plaintiff’s attempts.  Plaintiff therefore initiated a lawsuit in court and was subsequently awarded a judgment that included interest that was noted in the original contract that the defendant signed with the plaintiff.  

Outcome

The defendant failed to pay the judgment and California Court Collections was subsequently assigned to enforce the judgment.  California Court Collections was able to learn that the defendant owned a prominent restaurant where the plaintiff’s artwork was currently on display.  After a personal visit by California Court Collections to the defendant’s restaurant, the defendant refused to voluntarily pay the judgment.  A levy was ultimately obtained and monies paid from patrons were taken to apply towards the judgment resulting in full satisfaction of the judgment.
